He is 41 and just been renting there for the last two years.

How old is he? Anything until about 25 (maybe 27 or 28) I’d say is fine. It’s not like he’s mooching and living off of mommy and daddy or anything but he probably liked that he didn’t have to move, he was still around his family (which could mean strong relationships with people), or if he is in school or paying off student debts and such it could just be convenient and a little cheaper, or maybe he moved in when one of his parents was sick and they needed help and he just never moved out, etc. I wouldn’t consider it a red flag unless he is older, or if he is showing signs that he isn’t willing to ever move out, etc. Talk to him about it casually and ask what his reasons are and such, and while you are talking about it ask if he has any issues with possibly moving out in the future, etc.

I wouldn’t consider this the regular "living at home" kind of guy, because he is paying and he has his own space in the house it’s not just him living in his bedroom. Just talk to him about it!

No, there’s nothing you can do legally.

You could of course lock all the doors and board up all the windows and pass food through the letter box to keep them in….but then what?

You can chase them through the small claims court after they have left for rent arrears and any costs incurred. Usually it takes 3-6 months for them to show up on a People Search if they haven’t given you a forwarding address.. But they always slip up … new mobile phone, broadband, car license, TV license, Tax Ref… they register something somewhere and you can find them and issue the claim

Go directly to the seller yourself. If you do not know who it is or you may have doubt, try your County Recorder as property ownership information is public. Of course, assuming you reach contact the next step is to stress to SELLER you expect complete confidentiality regarding the transaction.
